Despite lengthy review by various Law Commissions over the years including the most recent one in 2014 when changes were recommended, and despite more couples living together than marrying, there is still little legal protection for separating couples, particularly where children are concerned. The myth of "common law husband and wife" still exists in the 21st century and it is difficult to get rid of it.

Cohabitation agreements

If you are not married and your relationship breaks down, unfortunately you do not have the same legal protection as married couples.

We can help you to come to an agreement to resolve any financial or children related matters but if an agreement cannot be reached, we can advise you on the following options:

Trusts of Land and Appointment of Trustees Act 1996
A person can make a claim against property or assets owned by someone else and we can help you to make this type of application.

Financial applications for children
Applications can be made under Schedule 1 of the Children Act 1989 for children whose parents are unmarried. We can advise on whether this type of application is appropriate for your circumstances.
